Key Outcomes from the 17th Meeting of the Customs Expert Group – Valuation Section

  • Adoption and Approval: The meeting, held virtually on November 26, 2024, saw the adoption of the agenda and approval of minutes from previous meetings. A future discussion on Transfer Pricing was noted for upcoming agendas.
  • Draft Guidelines on Undervaluation: The European Commission presented revised guidelines to assist customs officers in handling undervaluation audits, emphasizing flexibility and compatibility with WTO and EU legislation. Member States were invited to submit further comments by December 13, 2024.
  • Order of Sales Discussions: Several cases were analyzed regarding the determination of the sale for export within the EU customs territory. The debate highlighted differing interpretations of Article 128 UCC IA, with ongoing discussions planned for future meetings.
  • Unit Prices and Emissions Trading System (ETS): Challenges in collecting reliable data on unit prices for perishable goods were discussed, with proposals to amend reporting procedures. The inclusion of CO2 emissions costs in customs valuation was broadly supported, aligning with ECJ case law.
  • Information Sharing and Future Meetings: Updates from the 59th WCO Technical Committee on Customs Valuation were shared, with plans for the next session in April 2025. The WTO Committee on Customs Valuation is scheduled for December 2024 in Geneva. The next CEG-VAL meeting is tentatively set for early 2025.
