New Obligations for Foreign Road Carriers in Poland

As of July 1, 2024, foreign road carriers operating outside the European Union (EU) and conducting road transport within the territory of Poland have new obligations. Additionally, starting from January 1, 2025, these obligations will also apply to carriers from other EU Member States, Switzerland, or EFTA Member States when performing road transport to or from a third country based on permits required by international agreements binding Poland and that specific country.

1. Declaration Requirement:
   • Foreign road carriers must make a declaration in the system for monitoring the carriage of goods every time they operate within Poland.
   • This requirement applies to both non-EU carriers and carriers from other EU Member States, Switzerland, or EFTA Member States.
   • The declaration process involves notifying via the SENT register before crossing the Polish border.
2. Information Included in the Notification:
   • The notification submitted via the SENT register should include the following details:
     • Origin and destination countries: Information about where the transport begins and ends.
     • Particulars of the foreign entity conducting the road transport: Details about the carrier responsible for the transport.
     • Vehicle registration numbers: Identification of the vehicles involved in the transport.
3. Penalties and Sanctions for Non-Compliance:
   • Failure to comply with these new obligations can result in severe consequences:
     • Detention of the vehicle: Certain services may detain the vehicle if it lacks proper notification.
     • Financial penalties: Carriers may face fines of approximately EUR 5,000 for each transport.
     • Delays: If no notification is identified during the movement of goods, further delays may occur, preventing the transport from continuing until the situation is rectified.
4. Transport Permits and Consequences:
   • Transports performed without any notification registered in the SENT system will be considered as without a transport permit.
   • This lack of proper documentation may lead to unpleasant consequences for carriers.
