E-invoicing for B2B transactions from 2024

On July 25th, 2023, the European Commission granted Romania permission to implement a mandate for Business-to-Business (B2B) electronic invoicing (e-invoicing). This derogation request allows Romania to extend mandatory e-invoicing beyond high-risk VAT fraud transactions, applying it to all B2B transactions among taxable entities within Romania. This EU derogation is effective from January 1st, 2024, to December 31st, 2026, or in line with ViDA requirements.

Instead of a phased approach, Romania will enforce mandatory e-invoicing for domestic companies starting in 2024, though the specific date is yet to be determined. This means Romanian businesses must issue e-invoices for all B2B transactions with other Romanian companies and transmit them via the national electronic system, RO e-Factura. This change is expected to enhance efficiency by replacing manual processes and paper invoices, minimizing errors. Additionally, it will support the Romanian tax office by reducing tax evasion and fraud, offering real-time access to invoicing data and improved transparency.
