PEM-Zone Revised Origin Rules Effective from 2024: Transition and Application Details

  • Decision No 2/2024 of the Joint Committee of the Regional Convention on Pan-Euro-Mediterranean preferential rules of origin was published on December 19, 2024
  • This decision allows for the parallel application of old and revised rules as described in Newsletter No 33/2024
  • Publications have been made to enable a renewed transition phase for the parallel application of new and old rules
  • A new matrix indicates which countries are currently applying which set of rules
  • From January 1, 2025, the matrix published in the Official Journal C/2024/7561 will help identify the status of free trade agreements and cumulation possibilities using the labels CR, C, R
  • The matrix is expected to be regularly updated in the coming weeks to reflect the latest ratification status of PEM members
  • The European Commission has announced adjustments to the legal basis in the UZK-DVO for supplier declarations
  • Economic operators are advised to use the transitional rules for supplier declarations for goods that have obtained origin under these rules until the legal basis is adjusted
  • The German customs administration provided further details on cumulation, supplier declarations, and the parallel application of agreements in its report from December 23, 2024
  • The European Commission’s website also published the Guidance on transitional rules alongside Decision No 2/24
  • By January 1, 2026, only the rules of the revised PEM Convention will apply and all transitional rules will no longer be applicable
  • Contracting parties that have not incorporated a dynamic reference to the PEM Convention in their free trade agreements by the end of 2025 will be excluded from cumulation
  • The Swiss customs administration updated information for economic operators on December 30, 2024, which also provides insights into the EU’s approach
  • Economic operators should monitor further developments, especially regarding the application status of free trade agreements and cumulation possibilities
  • An updated version of the matrix is likely to be published in January 2025
  • Further decisions have been published in the Official Journal but not yet updated in the matrix, including decisions regarding Algeria, the Lebanese Republic, and Turkey
