Implementation of VIDA Package Won’t Alter KSeF Operating Rules in Poland

  • From February 2026, major Polish companies will be required to issue e-invoices in the KSeF system, with other businesses following in April 2026
  • Discussions are ongoing at the EU level regarding the VAT in Digital Age (VIDA) package
  • According to agreements made on November 5 at the ECOFIN Council meeting, from July 1, 2030, businesses will need to issue cross-border invoices in a EU format compliant with VIDA, while national invoices can be issued in this format voluntarily
  • By January 1, 2035, the EU e-invoicing standard will apply to both intra-community and domestic transactions
  • Poland has until 2035 to align its systems with EU standards, benefiting from a transition period granted to countries that had implemented e-invoicing before January 1, 2024, or had already done so
  • The Polish Ministry of Finance emphasizes its efforts to ensure that EU proposals do not significantly alter the functioning of KSeF in Poland
  • Businesses are awaiting specific solutions
  • Janina Fornalik, a tax advisor, notes that the Ministry of Finance is currently focused on implementing the National e-Invoice System (KSeF), one of the biggest reforms in recent years
  • The Ministry avoids a clear response regarding the adaptation of KSeF to future changes introduced by the VIDA package
  • Discussions are still ongoing about the final shape of the EU e-invoice scheme in B2B relations
  • It is known that the Polish xml format will differ from the EU format and will have a broader scope
  • Ideally, KSeF should allow conversion of xml to the EU format to ease the burden on businesses, but the technical feasibility of this remains uncertain
