The Noord-Holland District Court ruled that X’s actions in selling building plots went beyond mere private asset management. X bought a property in 2015, divided it into lots, and sold some in 2016. In 2019, X made an agreement with the municipality to create building plots for new homes. The court determined that X’s actions constituted a sustainable activity, and therefore X is considered a VAT taxable person in the subsequent sale of building plots.
