1. What is the general legislative framework regulating packaging and plastic waste in your jurisdiction?
The regulatory framework for packaging and plastics can be found in:
- Decree 2811 of 1974, the National Code of Renewable Natural Resources and Environmental Protection. Article 34 establishes the use of the best methods for collection, treatment, processing, or final disposal of waste. It also states that solid, liquid, and gaseous waste from industries or domestic activities must be reintegrated into the natural and economic process. In addition, it calls for the replacement of the production or import of products that are difficult to eliminate or re-incorporate into the production process; the development of methods of treatment, collection, deposit and final disposal of solid, liquid or gaseous waste not susceptible to new use.
- Resolution 1407 of 2018 regulates the environmental management of the packaging waste of paper, paperboard, plastic, glass, and metal. Its objective is to establish the obligation for producers to formulate, implement and keep updated a breadth of environmental management for packaging waste for use.
- Resolution 668 of 2016 regulates the rational use of plastic bags. Its purpose is to impose on the distributors of plastic bags the formulation and implementation of a programme of rational use of plastic bags.
