ECJ AG Opinion: n the absence of a permanent establishment, Airbnb does not have to appoint a tax representative

Advocate General Szpunar concludes that the Italian regulation requiring Airbnb to collect data on the leases concluded and provide it to the tax authorities is not a ‘technical regulation’. Italy therefore does not have to notify the EC in advance of the scheme.
